Rights Denied: A Discussion of State v Johnston (Minn 2021) and Potential Legislative Corrections

The Minnesota Supreme Court decided that the U.S. Constitution’s 6th Amendment right to effective assistance of counsel does not apply to a person with a Stay of Adjudication, when that person wishes to withdraw their plea after receiving bad advice. Joined by the opinion’s dissenter, Justice Paul Thissen, this CLE will review the case, analyze its chilling effect, and discuss potential legislative corrections.
